Terms of use
These Terms govern the use of Calderbin (the Service). By registering an account or uploading files you confirm that you have read and accept them in full.
1. Definitions
1.1. Service — the software and hardware available at this site, intended for storing and transferring files.
1.2. User — a person who has registered an account.
1.3. Content — any files or data uploaded by a User.
1.4. Link — a temporary address at which Content can be downloaded without signing in.
2. Accounts
2.1. Uploading files requires registration. Downloading via a Link does not.
2.2. The User is responsible for keeping their password safe and for all activity carried out under their account.
2.3. One person may hold one account. Creating accounts by automated means is prohibited.
2.4. The User may delete their account at any time from account settings. Deleting an account permanently removes every file they uploaded and every Link they issued.
3. Acceptable use
3.1. The Service is intended for storing and transferring files that belong to the User or that the User is entitled to distribute.
3.2. Creating load that interferes with other users is prohibited, including automated bulk uploading and downloading.
3.3. Circumventing the Service's technical limits is prohibited, including limits on file size, storage volume and request rate.
4. Prohibited content
4.1. It is prohibited to upload material that:
4.1.1. infringes the copyright or related rights of third parties;
4.1.2. contains malware, exploits or tools for unauthorised access;
4.1.3. contains personal data of third parties obtained unlawfully, including databases and leaks;
4.1.4. contains extremist material or incitement to violence;
4.1.5. contains sexual material involving minors;
4.1.6. otherwise breaches applicable law.
4.2. Such material may be removed without prior notice.
5. Quotas and limits
5.1. A free account provides 2048 MB of storage and a limit of 1024 MB per file.
5.2. Quota increases are granted on request and considered individually. A refusal does not have to be explained.
5.3. Limits may be changed, with notice given on the site.
6. Retention
6.1. Files are kept for 14 days from upload and are then deleted automatically.
6.2. Links are valid for 24 hours from creation.
6.3. The Service is not a backup system. Users must keep their own copy of anything they upload.
7. Rights in uploaded material
7.1. Content remains the User's. We acquire no rights in it beyond the right to store and transmit it so the Service can operate.
7.2. By uploading Content the User confirms they hold the rights needed to upload and transmit it.
8. Rights-holder notices
8.1. If material held in the Service infringes your rights, send a notice through the support form on the site, leaving an address we can reply to.
8.2. A notice must contain: the link to the material, a description of the right infringed, confirmation of the sender's authority, and contact details for a reply.
8.3. Access to the material may be suspended while a notice is under consideration.
9. Suspension and termination
9.1. Access to an account may be suspended or terminated for breach of these Terms, without prior notice in the case of a serious breach.
9.2. When access is terminated, uploaded files are deleted.
10. Liability
10.1. The Service is provided "as is". We do not guarantee uninterrupted operation or the preservation of files.
10.2. We are not liable for the contents of files uploaded by Users, nor for the consequences of a User passing a Link to third parties.
10.3. Planned work affecting availability is published on the site and on the status page.
11. Changes to these Terms
11.1. These Terms may be amended. The current revision is always published on this page with its date.
11.2. Continuing to use the Service after a change means accepting the new revision.
12. General
12.1. These Terms are governed by the law of the Russian Federation.
12.2. Processing of personal data is described in the Privacy policy.
12.3. For any question use the support form on the site.
